Ofcom has today issued a consultation on its proposed amendment to Rule 5.3 of the Broadcasting Code, following on from the recent High Court judgment in GB News v Ofcom. The judgment held that current affairs programmes are mutually exclusive from news programmes and are therefore not covered by the prohibition on politicians acting as newsreaders, interviewers or reporters in Rule 5.3, which currently applies only to news programmes.

Ofcom’s proposed amendment would expand the application of the prohibition on politicians acting as newsreaders, news interviewers and news reporters in Rule 5.3 to cover any type of programme, as opposed to only having effect in news programmes. Ofcom acknowledges that the way audiences consume news has changed over recent years, with news bulletins now often being broadcast within the context of other programming, rather than only in standalone news programmes, and sees the proposed change as better fulfilling its obligation to ensure that broadcast news is presented with due impartiality. Ofcom has also published proposed corresponding amendments to the Guidance accompanying Rule 5.3.

Ofcom has invited responses to the consultation (which can be accessed here), which must be received by 5pm on 23 June.
