Insights Ofcom consults on new regulatory fees regime for on-demand programme services (ODPS)

On 1 January 2016, Ofcom became the sole regulator for editorial content on ODPS. The Advertising Standards Authority is the co-regulator, with Ofcom, for advertising content on ODPS.

The new regulatory fees regime on which Ofcom is consulting would apply from the 2017/18 financial year onwards.

The consultation document outlines Ofcom’s preferred proposal for adopting a fees structure for the next financial year onwards. It shares the costs of regulating these services between the largest providers and does not involve a fee for smaller providers.

Ofcom has also provided an estimate of the 2017/18 fees that would be sufficient to meet, but not exceed, the likely cost of Ofcom carrying out the relevant functions in the financial year 2017/18.
