Insights GDPR: European Commission publishes Call for Evidence

On 11 January, the European Commission published a Call for Evidence to support the Commission’s evaluation and review of the GDPR. Under Article 97 GDPR, the Commission is required to review the GDPR in 2020 and every four years after that. The first report was adopted on 24 June 2020 and the next is due by mid-2024. All aspects of the GDPR will be assessed, save that the Commission will not be reviewing the cooperation and consistency mechanism between national data protection authorities (Chapter VII, GDPR) as these have been addressed in the Commission’s proposal for a Regulation on GDPR procedural rules, adopted on 4 July 2023. Evidence obtained from this Call will complement the input gathered from the GDPR Multi-Stakeholder Group set up by the Commission, the European Council, possible input from the European Parliament and input from the data protection authorities.

The final report may identify issues with the application of the GDPR and possible follow-up actions.
