Insights Body of European Regulators for Electronic Communications (BEREC) publishes report on the monitoring of termination rates for mobile and fixed voice calls

BEREC explains that Article 75(3) of the European Electronic Communications Code (2018/1972/EU) (EECC) requires that National Regulatory Authorities (NRAs) report annually to the European Commission and to BEREC on the application of Article 75, i.e., on implementation of the Union-wide termination rates for mobile and fixed voice calls under the Delegated Regulation (2021/654/EU).

The goal of BEREC’s report is to establish a common template for NRAs to use for their annual reporting. A template is included in the Annex to the report.

The template includes questions on the NRAs’ monitoring activities, their compliance with the Delegated Regulation for calls originating from Union-numbers and from third country numbers, and disputes raised with the NRAs in EU Members States. It also includes questions about auxiliary services and the misuse and/or fraudulent use of calling line identification.

BEREC is of the view that NRAs should provide yearly reports at the same time each year and recommends that reporting for 2021 is concluded before 30 September 2022 and before 31 March for subsequent years.

BEREC also proposes that for transparency and accountability reasons, following receipt of the annual reports, BEREC should publish a report summarising the main findings and conclusions.
